Terms of Service

1. Nature of Service
Tri-State Drive-Away (the "Provider") provides professional vehicle relocation services. The Provider operates the vehicle under its own power ("Drive-Away"). The Provider is NOT a towing or hauling service.
2. Vehicle Condition & Inspection
A pre-trip and post-trip inspection will be conducted. The Client (Dealership or Individual) warrants that the vehicle is in roadworthy condition, properly registered, and legally insured. Provider is not liable for mechanical failures (engine, transmission, electrical) that occur during normal operation.
3. Liability & Insurance
While the Provider maintains a professional driving record of 30+ years, the Client’s primary insurance acts as the lead coverage for the vehicle during transport. The Provider is not responsible for damage caused by "Acts of God," road debris (e.g., chipped windshields), or mechanical breakdown.
4. Independent Contractor Status
Thomas Murphy operates as a Sole Proprietor and Independent Contractor. This agreement does not create an employer-employee relationship.
5. Cancellation & Payment
Cancellations made within 24 hours of the scheduled pickup may be subject to a service fee. Payment is due upon delivery unless prior net-terms have been established in writing.
